All Users of the Smartbuild.com.au website agree to be bound by each policy below:

1. CONTENT POLICY

Smartbuild's Content Policy has been drafted to help all Users provide consistent advertising. To achieve this goal, Smartbuild maintains high standards for all business listings accepted into Smartbuild's Smart Directory TM advertising programme and other advertising on the Website.

All Advertisers on Smartbuild must be related to the Australian Building Industry. That is, all Advertisers must provide either products or services that contribute to the construction and/or fit-out/furnish of domestic & commercial dwellings / buildings, sheds, garages, civil works and alike. Products and services that also indirectly contribute to these works or the industry may also be advertised within Smartbuild.

The User acknowledges that:

(a) any images, sounds, Hyperlinks, intellectual property or text (Content) that is transmitted or posted on the Website, or otherwise transmitted to any other person by any other means, by the User has been authorised by it and must be complete and accurate;

(b) it agrees not to post or transmit on the Website, or otherwise transmit to any other User by any other means, Content that:

is unlawful, obscene, defamatory, indecent, offensive, false or misleading in any way, or inappropriate in the opinion of Smartbuild;
infringes the rights of any third party; or
contains viruses, or other computer codes, files or programs designed to interrupt, limit or destroy the functionality of other computer software or hardware.

(c) it will not create http links from the Website to other websites, or frame or mirror the website without Smartbuild's prior written consent;

(d) it will not use the Website, any of the facilities or information to send commercial, unsolicited or bulk electronic mail which would infringe the Spam Act 2003 (Cth);

(e) it's access to the Website is not prohibited by laws which may apply to it in its local jurisdiction;

(f) it is solely responsible for Content that it has transmitted or posted on the Website, or otherwise transmitted to any member of Smartbuild by any other means;

(g) Smartbuild accepts no responsibility for, and no liability with respect to, any Content transmitted or posted on the Website, or otherwise transmitted to any User by any other means, by any person;

(h) Smartbuild has the right, but has no obligation, to review and edit Content (including quotes or requests) transmitted or posted on the Website, or (where possible) otherwise transmitted to any member of Smartbuild by any other means;

(i) Smartbuild does not make any representations or warranties as to the accuracy, reliability or completeness of any Content (including information contained in requests for quotes or any quotes submitted) posted or transmitted on the Website, or otherwise transmitted to any other User by any other means, by any person. Furthermore, Smartbuild does not endorse any opinion, advice or statement made by any person other than itself. Smartbuild does not accept any liability for any Loss resulting from anyone's reliance on Content posted or transmitted on the Website, or otherwise transmitted to any other member of Smartbuild by any other means; and

(j) Smartbuild does not make any representations or warranties as to the merchantability or fitness for purpose of any of the goods or services contained on the Website;

(k) Smartbuild may from time to time accept advertisements that fall outside of it's Content Policy if Smartbuild deems it to be in the best interests of the website, its Users, Advertisers, and Partners.

2. EDITORIAL POLICY

This brief editorial guide will help Users create effective ads within Smartbuild. Alternatively, Smartbuild has several solutions for businesses which need help with their business listing, please contact Smartbuild to discuss the options available to Users.

This editorial guideline is based on 2 simple principles:

ACCURATE and clear description of the products and/or services being advertised;
RELEVANCE of the keywords, text, pictures and other content used within the advertisement.

Smartbuild's goal is to help Advertisers generate leads and sales to meet their business goals. To list products and services on Smartbuild, the Advertiser must adhere to all Policies and the Terms and Conditions.

Application of this policy will always involve an element of discretion and Smartbuild reserves the right to reject, approve and edit any advertisements in accordance with the Content Policy.

3. PAYMENT AND REFUND POLICY

Fees may be charged, from time to time, for the use of different facilities on the Website. All prices listed are in Australian Dollars and include GST unless otherwise stated. Where GST applies, Smartbuild will deduct the GST it incurs from each payment and will issue a tax invoice. Billing to all Users and Advertisers will be based on transactions as defined, accounted and audited by Smartbuild.

Smartbuild reserves the right to alter fees from time to time, in accordance with clause 10 of the Terms and Conditions.

Methods of Payment

Smartbuild accepts the following payment methods:

MasterCard & VISA - pay with your credit card either by phone, fax, post or online into Smartbuild's paypal account.

Cheque - payment is acknowledged only after cheque clearance.

Direct Bank Deposit - please use your customer number as the reference number.

PayPal - pay your Smartbuild account via PayPal

Other forms of payment may be accepted but only with prior arrangements.

Direct debit authorisations:
The User will be billed from their nominated account once they have submitted their application form to Smartbuild and it has been accepted. Direct debit will occur to the nominated account thereafter on the same date per calendar month. The User may cancel their direct debit authorisation by informing Smartbuild in writing via post or electronically.

The User is responsible for maintaining the correct contact and payment information associated with their account. Returned or cancelled payment bank/service fees due to any error in the User's contact or payment information are the User's responsibility, and will be charged to the User.

Refunds

Where fees have been paid by Users, the User will not be entitled to a refund of fees paid or pro rata part thereof if their account is terminated for a breach of the Terms and Conditions or Policies.
Please note that while Smartbuild will consider requests for refunds, such requests are not automatically approved or granted.



4. PRIVACY POLICY
When an enquiry is placed through Smartbuild, to ensure the enquiry is processed as efficiently as possible, a number of personal details are requested including your name, delivery address, email address and payment information. Smartbuild respects each User's privacy and will not sell or disclose any Personal Information to third parties unless:

the information is in the public domain (but not because of a breach of this policy);
disclosure is required by law, legal proceedings or a regulatory body;
it is to Smartbuild's employees and agents, the User's authorised representatives, Smartbuild's professional advisers or credit-reporting agencies (with the User's approval);
disclosure is made to a person who is required to know the information for the purpose of fulfilling the purchaser's enquiry provided that the person keeps the information confidential;
it is necessary for Smartbuild and the Advertiser or User to protect their rights;
it is to improve the products, services, systems and infrastructure offered by Smartbuild; or
the User acknowledges that Smartbuild may disclose their Personal Information.

Non-Personal Information may be collated and published for marketing, informational purposes or to improve and develop the Website.

The accuracy of all the information Smartbuild contains about Users is predominately dependent on the information supplied by the User. Users may access or alter their Personal Information from within their Smartbuild account or by contacting Smartbuild.com.au using the contact form on the Contact Us page.

Smartbuild contains links to other websites, all Linked Websites are responsible for their own privacy policies and Users should be aware of their terms and conditions.
